1. Introduction
Welcome to Ginsi. By using our service, you agree to these terms. Read them carefully before you start using the service.
These terms of service ("Terms") constitute a legally binding agreement between you and Ginsi AB (company registration no. 559581-0523), Stockholm, Sweden ("Ginsi", "we", "us", or "our") concerning your use of Ginsi's service at ginsi.ai and app.ginsi.ai ("Platform").
2. The service
Ginsi helps organizations collect and interpret evidence, retain company context, and build a basis for human decisions.
When the respective function is enabled, the service may include:
- import of supported data and management of company context
- aggregation and visualization of results
- code-supported analyses, recommendations, warnings, and follow-up
Research, roadmap, and demonstration material does not constitute a live function or a promise of a forecast.
3. User accounts and respondents
3.1 Organizations
An account is required to use the organization workspace. Users are admitted through the operator- and invitation-controlled process and are responsible for protecting their login credentials. The organization's owner can initiate deletion of the organization's account through settings. Other users must contact the organization's owner or Ginsi. Account deletion is separate from contract termination and product access.
3.2 Respondents
No account is required to respond to a public survey. The response flow does not request the respondent's name or email address and does not store a raw IP address with the response. Responses are pseudonymous. Anonymity is not guaranteed; free text may indirectly identify a person. Ginsi is designed to counteract individual identification and to hide results for small groups.
4. Subscription and payment
4.1 One subscription
Ginsi offers one subscription with the same product functions for all active customer organizations. Ginsi assigns and changes the subscription directly with the organization. Complimentary access and pilot access use the same subscription at SEK 0 and do not constitute a separate trial period or subscription tier.
4.2 Commercial terms
Pricing, payment terms, and termination are set out in the customer's agreement with Ginsi. The price may depend on the organization's size, integrations, and agreed scope. Contact Ginsi if you need to change the subscription or commercial terms. The Platform does not offer self-service commercial changes.
4.3 Legacy provider data
Stripe is a legacy payment integration undergoing provider reconciliation. Its event receiver is parked, meaning that it does not process signed provider events. Historical event records are retained for reconciliation, and legacy provider identifiers are retained to locate the corresponding provider record during the separate cleanup at account deletion. The organization's subscription status is the information used to determine active product access; legacy provider identifiers, prices, and tiers are not. This does not select Stripe or any other billing solution.
5. Automated analysis and insights
5.1 Insight analysis
Ginsi may analyze survey results to identify patterns, trends, and possible recommendations. The analysis uses pseudonymized and, depending on the path, aggregated or sanitized inputs. Privacy thresholds and de-identification are path-specific and cannot rule out identification through free text.
5.2 Analysis jobs
Configured analysis jobs may identify patterns and warnings, generate recommendations, and send notifications on the paths and with the settings that are enabled. Availability and execution frequency depend on the function's data requirements and configuration.
5.3 Limitations
Insights, recommendations, and warnings are inputs for decisions, not binding decisions. The customer organization is responsible for human review, its own decisions, and ensuring that the material is not used for individual monitoring or decisions with legal or similarly significant effects without a separate lawful assessment.
5.4 Data processing during AI analysis
On enabled analysis paths, survey inputs, aggregate statistics, and sanitized free text may be processed through Anthropic's API. Sanitization removes certain known patterns of direct identifiers but cannot guarantee that free text contains no indirectly identifying information. The processing region, transfer mechanism, provider terms, and retention period must be verified and approved before real personal data is processed. See the privacy policy.
6. Intellectual property rights
Ginsi AB owns the rights to the Platform. The customer retains the rights it has to its own content, subject to the rights of respondents and third parties. These terms do not transfer ownership of survey responses to Ginsi or the customer.
The customer grants Ginsi a limited right to process the customer's content to the extent required for the agreed service. What must be deleted, returned, or lawfully retained after the agreement ends must be addressed in a separate approved customer agreement and data processing agreement.
7. Content rules
You undertake not to use Ginsi to:
- Create surveys that are discriminatory, offensive, or contrary to Swedish law
- Collect sensitive personal data without complying with the GDPR's requirements for special protection
- Mislead respondents about the purpose of a survey
- Distribute malicious code through survey links
- Use the service for spam or bulk messages in violation of the Swedish Marketing Act
- Use the service to monitor individual employees or to identify or infer which employees hold specific opinions
Ginsi reserves the right to reject or remove surveys that violate these rules.
8. Limitation of liability
- The service is provided as is, without warranties of any kind
- We do not guarantee that the service is error-free or always available
- We are not responsible for the availability or failures of third-party providers
- Our maximum liability is limited to the fee you have paid to Ginsi during the preceding 12 months
- We are not liable for indirect damage, lost profits, or lost data
- We are not responsible for decisions the organization makes based on insights from the Platform
The limitations of liability above do not apply to intentional misconduct or gross negligence. They apply only to the extent permitted by applicable law and a separate customer agreement and do not affect rights or compensation claims that may not be limited, including data subjects' rights under applicable data protection law.
Force majeure: A party is relieved of liability for delay or failure to perform an obligation if the impediment is due to circumstances beyond that party's control, such as power outages, network outages, pandemics, labor disputes, decisions by public authorities, or subcontractor failures. If the impediment persists for more than 60 days, either party has the right to terminate the agreement.
9. Termination, access, and deletion
Termination of customer agreements, product access, suspension, data return, and tenant deletion are separate actions. Commercial termination and access changes are handled manually by Ginsi under the customer's separately agreed terms; the Platform does not offer self-service termination, suspension, or reactivation.
The organization's owner can initiate immediate or scheduled account deletion through settings. For scheduled deletion, the end of a remaining legacy provider period is used where such a record exists; in other cases, the code uses 30 days after the request. This is a technical rule for the existing deletion path and does not indicate whether the organization has Ginsi's subscription, terminate a customer agreement, or control product access.
Security or legal violations may need to be handled through a manual operator action and the applicable customer agreement. These terms do not claim that an automatic suspension process exists.
10. Changes to the terms
Ginsi may update these terms. Changes are published with a new update date. Where applicable law or a separate customer agreement requires specific information or renewed approval, this must take place before the change becomes effective for the customer.
11. Governing law and disputes
These terms are governed by and interpreted in accordance with Swedish law. Any disputes must first be addressed through negotiation. If the parties cannot reach an agreement, the dispute must be resolved by the Swedish general courts, with Stockholm District Court as the court of first instance, to the extent permitted by mandatory law.
12. Provisions that survive the end of the agreement
Provisions that, by their nature or under a separate customer agreement, are intended to apply after the agreement ends continue to apply. A separate data processing agreement governs which data protection commitments survive the processing.
13. Data protection requirements before customer processing
These public terms of service do not constitute a data processing agreement. If Ginsi is to process personal data on a customer's behalf, a separate, written, and approved data processing agreement is required before such processing begins.
The agreement must, at a minimum, establish the parties' roles and documented instructions; the subject matter, duration, nature, and purpose of processing; types of personal data; categories of data subjects; confidentiality; security measures; subprocessors and international transfers; assistance with data subjects' requests and incidents; audit information; and rules for data return, deletion, and lawful retention.
As data controller, the customer organization is responsible for establishing the legal basis, providing the necessary information, and assessing any processing of sensitive personal data. Ginsi must fulfill the obligations arising from applicable law and the approved agreement. Nothing in these terms limits data subjects' statutory rights.
This section does not approve a particular provider, list of subprocessors, processing region, transfer mechanism, retention period, form of audit, incident deadline, or offboarding process. These details must be decided and documented before real customer or respondent data is processed.
